The Office of Bar Counsel investigates and prosecutes ethical misconduct by Massachusetts attorneys, educates attorneys on the Rules of Professional Conduct, and works to protect the public and promote professionalism. The role investigates allegations through witness interviews, subpoenas, and information collection; analyzes potential violations; prepares charging memoranda, petitions, stipulations, affidavits, admonitions, and diversion agreements; participates in discovery, pre-hearing conferences, motions, witness preparation, and evidentiary hearings; prepares post-hearing submissions; writes appellate briefs and presents oral arguments; provides informal ethical opinions; represents Bar Counsel in reinstatement proceedings; presents educational programs; participates in office initiatives; and supervises investigative and secretarial staff. Applicants must be admitted to practice and in good standing in Massachusetts, have at least five years of legal practice including trial and appellate experience, demonstrate litigation, oral advocacy, legal writing, communication, interpersonal, and staff management skills, and show a commitment to diversity, equity, and inclusion.
